The Company:Market Financial Solutions (MFS) is a leading independent bridging finance provider based in the United Kingdom. With a strong presence in the market, we specialise in offering fast and flexible bridging loans and buy-to-let mortgages to our valued intermediaries and clients.The Role:The Legal Counsel – Recoveries will play a key role in providing legal support for the company’s recoveries and collections matters. You will work closely with the Recoveries & Collections team, other members of the Legal team and external counsel. In doing so, you will play a key part in protecting the company’s financial interests and ensuring efficient recoveries and effective resolution strategies for defaulted loans.Key Responsibilities:Take a lead role in enforcement in the event of borrower default, including:Drafting assignment documentation, demand letters, reservation of rights letters, amendment letters, consent letters and extension letters.Reviewing legal documentation associated with debt recovery including fixed charge receiverships, administrator appointments, bankruptcies, settlements and other property- related litigation.Advising on the options available to the business on borrower default and assist in the management of debt recovery, advising on enforcement.Managing and leading on enforcement action for the recovery of debts, including the appointment of fixed charge receivers and administrators.Appointing and working with external counsel in relation to enforcement action.Advise on and handle insolvency-related matters, including guarantee enforcement, bankruptcies and corporate insolvency.Liaising with external legal counsel, receivers, administrators, asset managers, and other stakeholders at all stages of both pre-enforcement and enforcement processes.The role will also entail: Monitoring legal developments in insolvency and property law and advise the business accordingly.Supporting the wider legal and credit risk teams on ad hoc queries relating to insolvency matters and risks.Maintaining detailed records and reporting for ongoing recoveries cases and proactively follow up on matters.Role Requirements:Qualified Solicitor in England & Wales, with experience in recoveries or property litigation(either in-house or in private practice).Demonstrable expertise (creditor side) in:o Distressed finance transactions;o Recoveries;o Fixed charge receiverships; ando Bankruptcy and related litigation.Experience advising lenders (regulated or unregulated) is highly advantageous.Strong commercial acumen and a pragmatic approach to legal problem-solving.Excellent review, written and verbal communication skills.Strong attention to detail and exceptional organisational skills.Comfortable managing a high caseload independently while contributing effectively and collaborating as part of a team.Resilient and capable of thriving in a fast-paced environment.This job would suit a talented and ambitious lawyer who is looking to move into a fast-moving and exciting environment, with the opportunity to advance their career.Why Work for us?Be Part of a Dynamic and Growing CompanyAnnual salary review & regular appraisalsBonuses and IncentivesEnhanced Maternity and Paternity Leave PackageExclusive Employee Discounts at Leading Retailers (covering groceries, technology, and holidays)Ongoing Staff Training and Development OpportunitiesPrivate Medical Health Care with VitalityLife Insurance CoverageAdditional Day Off to Celebrate Your BirthdayEngaging Work Networking and Team Building EventNext Steps:Ready for an exciting career move?
